SCOPE OF INSPECTION: Company will perform a limited visual inspection in accordance with the "Standards of Professional Practice" adopted by the Arizona Chapter of the American Society of Home Inspectors, Inc. on September 30, 2001, a copy of which is attached. The inspection will address major components and systems such as: site grading, roof, structure, cooling & heating, visible portions of plumbing & electrical systems, doors and windows, built-in appliances in an honest attempt to provide the customer with a better understanding of the property conditions At The Date Of Inspection. Any area inaccessible, and/or not exposed to view because of soil, walls, carpets, floors, ceilings, furnishings, or any other item, is not included in this inspection/report. Client agrees to assume the risk for all concealed items from view at the time of inspection or are outside the scope of the inspection. The inspection does not include any dismantling of equipment, systems or appliances or invasive or destructive testing. Minor and/or cosmetic defects, including wear and tear will be excluded. This is NOT a guarantee, warranty, insurance policy or substitute for the seller property disclosure. REPORT: The Company agrees to provide a computerized or written report. The report will indicate which items were inspected, which items are in need of immediate major repair or are not performing the function for which they are intended. Items not addressed in the inspection report are to be considered not inspected. No verbal statements by the Inspector shall expand the scope of this agreement or the inspection report, nor shall such statements be relied upon by the client when solicited from the inspector at any time. The inspection report is the property of the company and the client and shall not be used by or transferred to any other person or company without both the company's and clients written consent. CLIENT(S) agrees that the inspection will be of only visibly observable and accessible areas and components of the building. Observations are limited to the apparent condition of the building on the date of the inspection. No invasive or destructive testing will be performed. Latent or concealed defects and deficiencies are excluded from the inspection and report. The inspection will not include any area that has access or clearance less than twenty-four inches in any direction, or is not safely accessible from a fourteen-foot ladder. Additionally, Client understands and agrees that any area such as attics and crawlspaces may be limited as to thoroughness of inspection due to dangerously high temperature at certain times of year. INSPECTION REQUIREMENTS AND LIMITATIONS: The building, it's components and equipment, are to be ready and accessible at time of inspection. All utilities and pilot lights must be on and all equipment operational so the total inspection can be completed on that date. This is the responsibility of the Client. The inspector is not obligated to change light bulbs, light pilots, move furniture, obstructions, or floor coverings, or remove panels to inspect any part of the building or it's equipment. CLIENT agrees that the inspection and report provided are not intended to be used as a guarantee, warranty or any form of insurance, express or implied, regarding the adequacy, performance or condition of the building and any component, item or system on or within the property. Client further acknowledges and agrees that INSPECTOR disclaims all warranties, express or implied, regarding the inspection, except as otherwise stated in this Agreement. The inspector will not determine the operational capacity, quality or suitability for a particular use of items inspected. No Engineering, Scientific or specialized technician test or evaluation will be made by the inspector. No test sample or reading is required of any part of the “building”. The draft on the fireplace will not be checked. If repair is made prior to notification, Client’s recourse shall be deemed to be waived. ADDITIONAL TERMS, CONDITIONS AND LIMITATIONS Systems, items, and conditions which are not within the scope of the building inspection include, but are not limited to: outbuildings other than garages and carports, environmental hazards (molds, mildew, etc.); radon, formaldehyde, lead based paint, asbestos, toxic or flammable materials, pest infestation (termites, dry rot fungus, etc.)[Company may inspect for termites, mold, radon, lead based paint, asbestos if requested for additional fee]; household appliances, humidifiers, paint, wallpaper and other treatments to windows, interior walls, ceilings and floor coverings, recreational equipment or facilities, pool/spa water purification systems (ozone generator/salt water, etc.);security and fire protection systems; underground storage tanks; energy efficiency measurements; exterior motion or photo-electric sensor lighting; sprinkling/irrigation systems; water softener or purification systems; central vacuum systems, telephone, intercom or cable TV or satellite systems; antennae, lightning arrestors, load controllers; water wells; heating systems accessories; solar heating systems; trees or plants; governing codes, ordinances, statutes and covenants. Client acknowledges and agrees that these systems, items and conditions are excepted from this inspection. Any general comments about these systems, items and conditions in the Comments sections of the report are informal only and DO NOT represent an inspection. The Inspection and report are performed and prepared for the sole and exclusive use and possession of the CLIENT and in no way implies the insurability of the home. No other person or entity may rely on the report issued pursuant to this Agreement. In the event that any person, not a party to this Agreement, makes any claim against Inspector, its employees or agents, arising out of the services performed by Inspector under this Agreement, the CLIENT agrees to indemnify, defend and holdharmless Company/Inspector from any and all damages, expenses, costs and attorneys’ fees arising from such a claim. DEFINITIONS 1. Apparent Condition: Systems and components are rated as follows: SATISFACTORY - Indicates the component is functionally consistent with its original purpose but may show signs of normal wear and tear and deterioration. MARGINAL - Indicates the component will probably require repair or replacement anytime within five years. POOR - Indicates the component will need repair or replacement immediately or in the very near future. 2. Installed systems and components: structural components; exterior; interior; roofing; plumbing; electrical; heating; central air-conditioning and heat pumps (weather permitting); insulation and ventilation. SUPPLEMENTAL WOOD DESTROYING INSECT INSPECTION AGREEMENT PLEASE READ CAREFULLY PRIOR TO SIGNING This Agreement is intended as an amendment to the Home Inspection Agreement and addresses additional provisions involving a Wood- Destroying Insect Inspection Report (WDIIR). You agree that any and all provisions included in the Home Inspection Agreement and this supplemental Agreement apply to the Wood Destroying Insect Inspection. NOT A FUNGI/MOLD INSPECTION REPORT SCOPE OF THE WOOD DESTROYING INSECT INSPECTION (WDII):Your WDI Inspection is being conducted in accordance with any applicable state and/or local licensing requirements. The purpose of the Wood Destroying Insect (WDI) Inspection is to detect wood destroying Insect infestations, their damage and conducive conditions which destroy and/or promote high moisture content in wood in those areas of the structure that are readily accessible to visual inspection and not excluded on the WDI Inspection Report. If such insects, their damage and/or conducive conditions are visible, the WDI Inspection Report will provide corrections recommended to assist in elimination. A WDI Inspection Report is a written opinion of a qualified inspector based upon what was visibly evident at the date of the inspection. LIMITATIONS OF THE WDI INSPECTION:(a) INACCESSIBLE AREAS: Certain areas of a structure may be subject to attack which are inaccessible to inspection. Such areas cannot be seen by a visual inspection unless physical obstructions and stored items or furnishings are removed, excavated or torn out. Neither the Inspector nor their firm shall be responsible in any manner by any part for any infestation, damage or conducive condition concealed in an inaccessible area. Inaccessible areas of the structure will be noted on the WDI Inspection Report. The inspector will not remove insulation in order to conduct the inspection. Insulation obstructs full inspection of the subfloor, attic and other areas. All areas hidden by insulation are excluded from the inspection.(b) FUTURE CONDITIONS: The inspection shall cover only current conditions visible and accessible at the time of the inspection. It shall not cover latent conditions not visible or revealed by minor probing and sounding. Minor probing and sounding is generally limited to the large structural wood members within the areas inspected. The inspector nor their firm shall in no way be held responsible for future infestations, damages or conditions that were not visible at the date of the inspection. It is a “snap shot” in time and does not constitute a warranty of any nature and should not be construed as one.NOTE: There are certain wood destroying insects that go dormant during certain times of the year and may not be visible during the inspection due to their seasonal activity cycles. Therefore, neither the Inspector nor their firm will be responsible for infestations that may not be visible on the date of the inspection due to seasonal activity cycles of certain insects.(c) REQUIREMENTS OF OTHERS: The inspector and their firm shall not be held responsible for the requirements above and beyond his/her Report which may be instigated by any other inspector (government or private) for the purpose of obtaining building permits, securing loans, finalizing real estate transactions and/or otherwise affecting the status of principles involved except as directly related to the presence of wood destroying insects, their damage and conducive conditions. OTHER WDI INSPECTION PROVISIONS By signing below, You acknowledge that you have read this Agreement, that You will read the WDI Inspection Report and all attachments before purchasing the property, that You understand the terms of this Agreement and acknowledge receipt.
